Matt specialises in employment and health and safety, advising on a range of projects, disputes and litigation in each field. He is well versed in representing clients in disputes, from early resolution to appearances in Court.

Matt primarily acts for large corporates across many industries. His work is evenly split between employment and health and safety.

On the employment side, Matt advises clients on a variety of issues including contract and policy preparation, disciplinary and performance management, medical incapacity processes, restructuring, payroll and leave remediation, restraints of trade, business acquisition due diligence, and workplace investigations. He is also experienced in dispute resolution and represents clients from the initial raising of a personal grievance right through to appearances in the Employment Relations Authority, Human Rights Review Tribunal and Employment Court. Matt approaches disputes with a commercial lens in order to achieve a palatable settlement that suits each client.

As to health and safety, Matt similarly assists clients in non-dispute related advice, including preparation of policies and advising on incident investigations. The largest part of his practice in this area, however, is assisting clients with WorkSafe investigations and prosecutions. Matt regularly attends WorkSafe duty holder interviews and appears in the District Court in defence of prosecutions.

In addition, and often related, to the above work, Matt advises New Zealand’s largest insurers on indemnity issues arising from claims made under employment disputes and statutory liability policies.

Employment

  • Advising a large corporate client in the manufacturing industry, on remediation of taxable benefits covering a 6-year span.
  • Advising a large charitable client in the community care industry, on remediation of in-between travel overpayments in excess of $250,000.
  • Representing a medium size charitable client in the community care industry, during a 3-day Employment Court hearing.
  • Representing a large corporate client in the manufacturing industry, in an urgent interim reinstatement application in the Employment Relations Authority.
  • Representing an SME in the retail industry, in a constructive dismissal case in the Employment Relations Authority.

Health and Safety

  • Obtaining a dismissal of charges brought by a private prosecutor against an SME, in the District Court.
  • Representation of multiple corporate clients, in various industries, in sentencings in the District Court.
