We regularly assist major New Zealand-based banks, finance companies, private lenders and borrowers, financial advisers, investors and corporates with all aspects of their banking and finance legal needs. This includes lending facilities (including project, construction, property, assets, trade and consumer finance), subordinated and mezzanine financing, securities, capital raising, insolvency matters and financing litigation.
A number of our team members have worked in banks and lending institutions so we know the sector well, speak your language and understand what delivering commercial advice means. Recently, we’ve helped a number of our clients get to grips with the forthcoming change in Securities legislation, taking them through the probable implications of this. We’ve also been heavily involved in the Anti-Money Laundering Act, advising lenders and finance companies on their obligations around this. It’s part of moving on tomorrow, today.
We have acted on all manner of transactions from documenting and settling high volume, lower value loans, to complex commercial arrangements and corporate financing, to lending, to listed entities and on trans-Tasman loans and securities. For example, we recently assisted one of New Zealand’s major banks on refinancing and business acquisition deals where the threshold was above the bank’s in-house limits, including leading the deal in trans-Tasman financing.
We work with New Zealand’s major banks and a number of finance companies choose us to advise on their capital raising, lending activities and general compliance issues. We also advise fund managers, trustees and statutory supervisors on securities and other compliance issues arising from various debt, participatory and unit security issues.
Our banking and finance team work closely with our highly regarded national litigation team who have experience in all contentious aspects of banking and finance, including debt recovery.
