The article looks at how and when Worksafe intervenes when it becomes aware of mental health issues in the workplace. It examines the challenges involved in regulation and intervention, as well as the intersection between employment law and regulatory defence when health and safety concerns arise out of a bullying allegation.

To conclude, the article outlines points for employers to consider in order to reduce the risk of psychosocial harm in the workplace and avoid the risk of prosecution.
