Hayley regularly assists clients with advice regarding issues such as restructuring and redundancy, performance management, disciplinary processes, raising or responding to personal grievances or addressing bullying and harassment.  She can adeptly represent clients if a claim progresses to mediation, the Employment Relations Authority or further.

Hayley also has experience conducting employment investigations, both in New Zealand and in the UK arising from internal complaints including bullying, harassment, racism and sexism.  She has conducted investigations into specific misconduct complaints and more broadly into team- or organisation-wide cultural concerns.

Recent highlights

  •         Supporting and advising a large public sector client regarding the complex dismissal of an underperforming and dishonest employee, who had raised complaints against a number of different managers/supervisors and had made a claim to the Human Rights Commission.
  •           Advising a client in the finance sector on concurrent restructuring and disciplinary matters concerning the same individual.
  •     Supporting a client to run a performance improvement process for a senior team leader and responding to concerns and issues raised throughout the process.
  •          Advising a large national client on the relocation of one of their offices and the effect on employees, including the circumstances when redundancy provisions would apply.  
  • Responding to and resolving a range of personal grievances through negotiation and representing clients in mediation.
  • Conducting an investigation into complaints raised by multiple members of a People and Culture team against their manager for bullying and mismanagement. The report included an analysis of issues with the team’s culture and possible ways to address those issues.
  • Investigating allegations of bullying and sexism against senior executives from a multinational client, with cross-border reporting lines and differing cultures. Following the investigation, providing recommendations on internal changes to avoid such situations in the future.
  • Investigating several allegations of misconduct by a registered medical practitioner at a rest home, which included conducting sensitive interviews with residents and other staff.
